Terms and Conditions for Aura Yacht Charters

1. Agreement to Terms
By accessing our website, www.miamiaura.com (the "Site"), and booking or using the yacht charter services offered by Aura Yacht Charters ("Company," "we," "us," "our"), you agree to be bound by these Terms and Conditions. These terms govern your access to and use of our services.
2. Yacht Charters and Bookings
Availability: All charters are subject to vessel and crew availability. We reserve the right to refuse any booking at our discretion.
Booking Process: Bookings are confirmed only upon receipt of a signed charter agreement and a specified deposit. Final payment is due by the date specified in your agreement.
Pricing: Prices are subject to change without notice. The price for your charter is locked in once your deposit is received. Prices do not include crew gratuity, which is customary in the industry.
Cancellation Policy: Our cancellation policy will be outlined in your individual charter agreement. Cancellations may result in the forfeiture of your deposit or other payments. We reserve the right to cancel a charter due to unsafe weather conditions, mechanical failure, or other unforeseen circumstances. In such cases, we will work with you to reschedule or provide a refund.
Guest Responsibilities: The charterer is responsible for the conduct of their guests. All guests must comply with the captain's instructions, particularly regarding safety and vessel operation. Illegal activities, including the use of illicit drugs, are strictly prohibited and will result in the immediate termination of the charter without a refund.
3. Intellectual Property Rights
The Site and its original content, features, and functionality are the proprietary property of Aura Yacht Charters. This includes all source code, text, photographs, and graphics (the "Content") and the trademarks and logos contained therein, which are protected by copyright and trademark laws.
4. Disclaimer of Warranties
THE SITE AND OUR CHARTER SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. WE DO NOT GUARANTEE THAT YOUR CHARTER WILL BE FREE FROM THE IMPACTS OF WEATHER, SEA CONDITIONS, OR OTHER EVENTS BEYOND OUR CONTROL.
5. Limitation of Liability
IN NO EVENT WILL WE, OUR DIRECTORS OR EMPLOYEES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF OUR SERVICES.
6. Governing Law
These Terms and Conditions shall be governed by and defined following the laws of the State of Florida and the United States of America. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
7. Changes to These Terms
We reserve the right to change or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated terms on the Site.
